SECTION 1: GENERAL WAIVER AND RELEASE OF LIABILITY

BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.

I, the undersigned participant, hereby acknowledge that I have voluntarily chosen to participate in swimming and related activities at a private pool facility arranged through Pool Rental Near Me (“PRNM”). I understand that swimming and related water activities involve inherent risks that may result in serious injury, illness, or death.

A. ASSUMPTION OF RISK

I FULLY UNDERSTAND AND ACKNOWLEDGE THAT:

• Swimming pools present inherent risks including but not limited to drowning, near-drowning, slip and fall injuries, head injuries, broken bones, paralysis, and death;
• Pool chemicals, equipment, and surroundings may cause injury or allergic reactions;
• Pre-existing medical conditions may be aggravated by swimming activities;
• NO LIFEGUARD IS ON DUTY at any pool facility arranged through PRNM;
• I AM SOLELY RESPONSIBLE for my safety and the safety of any minors under my supervision;
• Consumption of alcohol or drugs increases risks and may impair judgment, and I agree not to consume alcohol or drugs that impair my ability during the activity or assume all additional risks if I do;
• I VOLUNTARILY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of PRNM, the Host, or others, and assume full responsibility for my participation.

B. RELEASE OF LIABILITY

I, FOR MYSELF AND ON BEHALF OF MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS:

• Pool Rental Near Me LLC; • PRNM Corp; • 10,000 Solutions (technology company of PRNM); • Any affiliated businesses operating under PRNM; • The Host (property owner or manager); • All officers, directors, employees, volunteers, representatives and agents of the aforementioned entities;

FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, AND LIABILITY arising out of or related to any injury, disability, death, or loss or damage to person or property, WHETHER ARISING FROM NEGLIGENCE OR OTHERWISE, to the fullest extent permitted by law. This release does not apply to claims arising from gross negligence, willful misconduct, intentional acts, or where prohibited by applicable law.

I FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS the above entities for any damage to the Host’s property caused by me or anyone under my supervision.
